Algérie: le CMA exige la libération de tous les détenus politiques Kabyles et Amazighs

Le Congrès Mondial Amazigh (CMA) prend acte de la remise en liberté le 18 octobre 2022 d’un certain nombre de citoyens Kabyles injustement arrêtés et incarcérés en 2021 par les autorités algériennes, suite à des accusations notamment de «terrorisme» et d’«atteinte à l’unité nationale».

 

Ces personnes ont été libérées après plus d’une année de détention provisoire, à l’issue de simulacres de procès, sans preuves et où les droits de la défense ont été largement bafoués. En réalité, la justice algérienne a condamné ces personnes parce qu’elles sont Kabyles et qu’elles tiennent à le rester et parce qu’elles ont osé user de leur droit de s’exprimer librement conformément à la Constitution algérienne et au droit international.

 

Le CMA partage la joie des personnes qui ont retrouvé leur liberté, leurs familles et leurs amis. Toute la Kabylie les a accueillis comme des héros, dans une ambiance de victoire. Le CMA salue la dignité et la détermination des ex-détenus qui ont déclaré à leur sortie de prison que la peine qui leur a été infligée est une punition injuste et inacceptable car elle ne repose sur aucun motif légal et légitime.

 

Le CMA alerte une nouvelle fois les instances régionales et internationales, les ONG et tous les défenseurs des droits de l’homme et des peuples, sur le fait que les tribunaux algériens ont condamné d’autres citoyens Kabyles à 20 ans de prison avec l’accusation de terrorisme, mais là aussi, sans aucun élément de preuve et hors des normes juridiques internationales pertinentes. Le seul  «crime» commis par ces condamnés est de défendre de manière démocratique et pacifique, les libertés fondamentales et le droit à l’autodétermination pour le peuple kabyle.

 

D’autres citoyens Kabyles et Amazighs, dont Kamira Nait Sid, coprésidente du CMA, en détention provisoire depuis près de 14 mois, attendent leur procès. Le 1er avril 2022, l’ONU a estimé que Kamira Nait Sid était en situation de détention arbitraire et par conséquent, il n’y a pas lieu de la juger mais de la libérer immédiatement et de réparer les préjudices moraux et matériels qu’elle a subis. Tous les détenus Kabyles et Amazighs en Algérie sont juridiquement dans le même cas que celui de la coprésidente du CMA. Pour eux, la seule solution conforme au droit est qu’ils soient tous libérés et indemnisés pour les injustices et les souffrances qui leur ont été infligées.

 

Le CMA, ONG de protection et de promotion des droits des Amazighs, dénonce avec force le racisme, les discriminations et les violences, y compris la torture, exercés par les autorités algériennes contre les Kabyles et les Amazighs. Le CMA assure de son soutien indéfectible toutes les victimes des abus de pouvoir en Algérie et réaffirme son engagement à agir sans relâche pour l’état de droit et la reddition des comptes par les responsables algériens à tous les niveaux.

Algeria: CMA demands the release of all political detainees

Kabyles and Amazighs

 

The Amazigh World Congress (CMA) takes note of the release on 18 October 2022 of a number of Kabylian citizens unjustly arrested and imprisoned in 2021 by the Algerian authorities, following accusations of, among other things, "terrorism" and "attacking national unity". These people were released after more than a year of pre-trial detention, after sham trials, without evidence and where the rights of the defence were largely flouted. In reality, the Algerian justice system condemned these people because they are Kabyles and want to remain so, and because they dared to use their right to express themselves freely in accordance with the Algerian Constitution and international law.

 

The CMA shares the joy of those who have regained their freedom, their families and friends. The whole of Kabylia welcomed them as heroes, in an atmosphere of victory. The CMA salutes the dignity and determination of the ex-detainees who declared on their release from prison that the sentence imposed on them is an unjust and unacceptable punishment as it is not based on any legal and legitimate grounds.

 

The CMA once again alerts regional and international bodies, NGOs and all defenders of human and peoples' rights to the fact that the Algerian courts have sentenced other Kabylian citizens to 20 years in prison on charges of terrorism, but again without any evidence and outside the relevant international legal standards. The only "crime" committed by these convicts is to defend in a democratic and peaceful way, the fundamental freedoms and the right to self-determination for the Kabyle people.

 

Other Kabyle and Amazigh citizens, including Kamira Nait Sid, co-president of the CMA, who have been in pre-trial detention for nearly 14 months, are awaiting trial. On 1 April 2022, the UN ruled that Kamira Nait Sid was in a situation of arbitrary detention and therefore there is no reason to judge her but to release her immediately and to repair the moral and material damage she has suffered. All the Kabylian and Amazigh detainees in Algeria are legally in the same situation as the co-president of the CMA. For them, the only solution in accordance with the law is that they should all be released and compensated for the injustices and suffering that have been inflicted on them.

 

The CMA, an NGO for the protection and promotion of Amazigh rights, strongly denounces the racism, discrimination and violence, including torture, exercised by the Algerian authorities against the Kabyles and Amazighs. The CMA assures all victims of the abuse of power in Algeria of its unwavering support and reaffirms its commitment to act relentlessly for the rule of law and accountability by Algerian officials at all levels.
