Algérie: l'ONU réclame la libération de Kamira Nait Sid

Algérie : Kamira Nait Sid est une défenseure des droits humains et sa détention est arbitraire, d’après l’ONU

 

Le Groupe de Travail de l’ONU sur la détention arbitraire (GTDA-ONU), après avoir examiné les plaintes pour enlèvement, séquestration et détention arbitraire de Kamira Nait Sid le 24 août 2021 en Algérie, déposées par le CMA et Riposte Internationale et suite aux réponses aux questions posées par le GTDA-ONU au gouvernement algérien, le GTDA-ONU a jugé le 1/04/2022 (A/HRC/WGAD/2022/15) que :

 

1. Mme Nait Sid a été enlevée et séquestrée par des agents de l’Etat algérien, ce qui constitue «une forme particulièrement grave de détention arbitraire»,

2. les activités de défense des droits des Amazighs menées par Mme Nait Sid, sont protégées par le droit à la liberté d’expression garanti par l’article 19 de la Déclaration Universelle des Droits de l’Homme (DUDH) et par l’article 19 du Pacte international sur les droits civils et politiques, et que l’intéressée a été placée en détention pour avoir pacifiquement exercé ce droit,

3. en sa qualité de coprésidente du CMA, Mme Nait Sid exerçait pacifiquement le droit à la liberté d’association garanti à l’article 20 de la DUDH et l’article 22 du Pacte international sur les droits civils et politiques, et elle a été arrêtée pour cette raison. Et notamment pour s’être pacifiquement employée à défendre son droit et celui des autres membres de la communauté amazighe d’avoir leur propre culture, de professer et de pratiquer leur propre religion et d’employer leur propre langue, garanti à l’article 27 du Pacte,

4. le Gouvernement algérien ne fait état d’aucune activité menée par Mme Nait Sid pouvant être considérée comme constitutive d’un acte de terrorisme. En l’absence d’informations démontrant son implication dans des actes de violence, aucun motif légitime ne justifie que l’exercice de ses libertés soit restreint,

5. le Gouvernement n’explique pas en quoi il était nécessaire de poursuivre Mme Nait Sid en justice pour protéger un intérêt légitime ou en quoi l’accuser de graves crimes terroristes passibles de longues peines d’emprisonnement était une réaction proportionnée aux activités reprochées. En outre, rien ne prouve que le comportement ou les activités de Mme Nait Sid pouvaient être considérés comme une menace pour la sécurité nationale, l’ordre public, la santé ou la moralité publiques, ou les droits ou la réputation d’autrui. Le Gouvernement ne mentionne expressément aucun acte de terrorisme commis par Mme Nait Sid. Le Groupe de travail en déduit que l’intéressée a été arrêtée et placée en détention parce qu’elle est membre de la communauté amazighe et qu’elle défend les droits de celle-ci,

6. Mme Nait Sid est détenue pour avoir exercé les droits consacrés aux articles 19 et 20 de la Déclaration Universelle des Droits de l’Homme et aux articles 19, 22 et 27 du Pacte international sur les droits civils et politiques et que sa privation de liberté est contraire aux dispositions de l’article 7 de la DUDH et de l’article 26 du Pacte. L’arrestation et la détention de Mme Nait Sid sont dénuées de fondement juridique et sont donc arbitraires,

7. Mme Nait Sid est privée de liberté pour des motifs discriminatoires, à savoir son origine nationale, ethnique ou sociale et sa qualité de défenseuse des droits humains, en violation des articles 2 et 7 de la DUDH et des articles 2 et 26 du Pacte sur les droits civils et politiques. En conséquence, aucun procès concernant Mme Nait Sid ne devrait avoir lieu,

8. le Gouvernement algérien doit procéder immédiatement et sans condition à la libération de Mme Nait Sid, arbitrairement privée de liberté depuis le 24 août 2021, et veiller à ce qu’elle reçoive les soins médicaux nécessaires. Le Gouvernement doit également lui accorder le droit d’obtenir réparation, notamment sous la forme d’une indemnisation, conformément au droit international,

9. le Gouvernement algérien doit veiller à ce qu’une enquête approfondie et indépendante soit menée sur les circonstances de la privation arbitraire de liberté de Mme Nait Sid, et de prendre les mesures qui s’imposent contre les responsables de la violation de ses droits,

10. le Groupe de travail demande au Gouvernement algérien d’user de tous les moyens à sa disposition pour diffuser le présent avis aussi largement que possible.

Algeria: Kamira Nait Sid is a human rights defender and her detention is arbitrary,

according to the UN

 

The United Nations Working Group on Arbitrary Detention (UN-WGAD), after examining the complaints of abduction, unlawful confinement and arbitrary detention of Kamira Nait Sid on 24 August 2021 in Algeria, filed by the CMA and Riposte Internationale and following the answers to the questions put by the UN-WGAD to the Algerian government, the UN-WGAD ruled on 1/04/2022 (A/HRC/WGAD/2022/15) that :

 

1. Ms Kamira Nait Sid was abducted and detained by Algerian state agents, which constitutes "a particularly serious form of arbitrary detention",

2. Ms. Nait Sid's activities in defence of the rights of the Amazigh people are protected by the right to freedom of expression guaranteed by Article 19 of the Universal Declaration of Human Rights (UDHR) and by Article 19 of the International Covenant on Civil and Political Rights, and that she was detained for peacefully exercising this right,

3. in her capacity as co-president of the CMA, Ms. Nait Sid was peacefully exercising the right to freedom of association guaranteed in Article 20 of the UDHR and Article 22 of the International Covenant on Civil and Political Rights, and she was arrested for this reason. In particular, she was arrested for peacefully defending her right and that of other members of the Amazigh community to enjoy their own culture, to profess and practise their own religion and to use their own language, as guaranteed by article 27 of the Covenant,

4. The Algerian Government does not report any activity carried out by Ms. Nait Sid that could be considered as constituting an act of terrorism. In the absence of information demonstrating her involvement in acts of violence, there are no legitimate grounds for restricting the exercise of her freedoms,

5. the Government did not explain why it was necessary to prosecute Ms Nait Sid in order to protect a legitimate interest or why charging her with serious terrorist crimes carrying long prison sentences was a proportionate response to the activities complained of. Furthermore, there was no evidence that Ms Nait Sid's conduct or activities could be considered a threat to national security, public order, public health or morals, or the rights or reputations of others. The Government does not specifically mention any act of terrorism committed by Ms. Nait Sid. The Working Group concludes that she was arrested and detained because she is a member of the Amazigh community and defends its rights,

6. Ms. Nait Sid is detained for exercising the rights enshrined in articles 19 and 20 of the Universal Declaration of Human Rights and articles 19, 22 and 27 of the International Covenant on Civil and Political Rights and that her deprivation of liberty is contrary to the provisions of article 7 of the UDHR and article 26 of the Covenant. The arrest and detention of Ms. Nait Sid are devoid of any legal basis and are therefore arbitrary,

7. Ms. Nait Sid is deprived of her liberty on discriminatory grounds, namely her national, ethnic or social origin and her status as a human rights defender, in violation of Articles 2 and 7 of the UDHR and Articles 2 and 26 of the Covenant on Civil and Political Rights. Consequently, no trial concerning Ms. Nait Sid should take place,

8. The Algerian Government must immediately and unconditionally release Ms. Nait Sid, who has been arbitrarily deprived of her liberty since 24 August 2021, and ensure that she receives the necessary medical care. The Government must also grant her the right to obtain redress, including compensation, in accordance with international law,

9. The Algerian Government should ensure that a thorough and independent investigation is carried out into the circumstances of the arbitrary deprivation of liberty of Mrs. Nait Sid, and take appropriate action against those responsible for the violation of her rights,

10. The Working Group requests the Government of Algeria to use all means at its disposal to disseminate the present Opinion as widely as possible.
